Walk With Emi — Terms of Use

These terms are an agreement between you and Port Point LLC ("we", "us") governing your use of the Walk With Emi app. By using the app, you agree to them. Contact: support@walkwithemi.com.

1. Not medical advice

Walk With Emi is a fitness and motivation app, not a medical device. It does not diagnose, treat, or prevent any condition. Step, distance, and calorie figures come from your device's sensors through Apple Health and are estimates that may be inaccurate. Consult a qualified health professional before beginning any exercise program, and stop any activity that causes pain, dizziness, or discomfort. You are responsible for your own safety while walking — pay attention to traffic and your surroundings rather than your phone.

2. Eligibility and your account

You must be at least 13 years old to use the app. You are responsible for the phone number and device used to access your account and for activity that happens under it. Provide accurate profile information and keep it current.

3. Acceptable use

Do not: falsify step data or use mechanical means to inflate counts; harass, bully, threaten, or impersonate anyone; post unlawful, hateful, or sexually explicit content; attempt to access other users' data; or interfere with the service. We may remove content, suspend, or terminate accounts that violate these terms.

4. Your content and other users

You keep ownership of what you create. You grant us permission to store and display it as needed to run the app. Content and activity from other users is theirs, not ours — we do not endorse it. You can block a user by removing them as a friend, and you can report abuse to the contact address above; we review reports and act on them.

5. Subscriptions and payments

Some features may require a paid subscription purchased through the Apple App Store. Payment is charged to your Apple Account at confirmation. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and your Apple Account is charged for renewal within 24 hours of the period ending. Manage or cancel subscriptions in your Apple Account settings; deleting the app does not cancel a subscription. Any unused portion of a free trial is forfeited when you purchase a subscription. Refunds are handled by Apple under its policies. We may grant complimentary access to some users at our discretion, and may end complimentary access at any time.

6. Availability and changes

We may modify, suspend, or discontinue features at any time, and may require you to update to a supported version of the app to keep using it. We aim to give notice of significant changes but cannot guarantee uninterrupted service.

7. Termination

You may stop using the app and delete your account at any time from Account → Delete account. We may suspend or terminate accounts that violate these terms or create risk for others.

8. Disclaimers

The app is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, arising from your use of the app. Our total liability for any claim relating to the app is limited to the greater of the amount you paid us in the twelve months before the claim, or twenty-five US dollars. Some jurisdictions do not allow these limitations, in which case they apply to the maximum extent permitted.

10. Governing law

These terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Cook County, Illinois.

11. Apple

Apple is not a party to these terms and is not responsible for the app or its content. Apple has no obligation to provide support or maintenance for the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Changes to these terms

We may update these terms and will revise the date above. Continued use after changes take effect means you accept the updated terms.
